Probate and Estate Administration

We guide individuals and families through the entire estate administration and probate process, including:

  • Determining whether there is a will
  • Probating the will within six months of the date of death
  • Appointing an executor or administrator
  • Valuating and collecting the estate property
  • Evaluating and paying estate debts
  • Determining who has the right to each piece of property and notifying the heirs

Determination of Descent

You may also wait six months to bring a "Determination of Descent" proceeding if your family member did not have a will and left the real estate solely to his or her name. In this case, you do not have to notify creditors. The proceeding will determine who should receive what assets and in what shares. It takes approximately 30 days.

Small Estates: Probate May Not Be Necessary

For smaller estates, probate may not be necessary so long as the estate only consists of personal property and the estate is worth less than the demands against it. We can help you file the necessary paperwork (affidavit).
